These Terms & Conditions ("Terms") govern your access to and use of Falando (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2) Eligibility and Accounts

• You must be at least 13 years old to use the Service. If you are under 18, you represent that you have consent from a parent or legal guardian, as required by applicable law.
• You agree to provide accurate information and keep your account secure. You are responsible for all activity under your account.
• We may suspend or terminate accounts that violate these Terms or applicable law.

3) The Service

Falando is a language-learning service offering educational content and practice features. The Service may differentiate features by plan type (e.g., free user, paid user, admin). Access to certain content or levels may be restricted based on your plan.

We may add, change, or remove features from time to time. We will take reasonable steps to notify users of material changes.

4) Subscriptions, Trials, and Billing

• Paid plans may be offered on a subscription basis. By subscribing, you authorize us or our payment provider to charge the applicable fees.
• Fees, billing cycle, and renewal terms will be presented at checkout. You can cancel before the next billing cycle to avoid renewal charges.
• Refunds, when applicable, will follow the terms disclosed at purchase and applicable consumer laws in Brazil.
• We do not store full payment card details on our servers; payments are processed by third-party providers.

5) Acceptable Use

• Do not misuse the Service, including by attempting to access content or features you do not have rights to use, circumventing access controls, or interfering with normal operation.
• Do not copy, distribute, publicly display, or create derivative works from the Service or its content except as expressly permitted by law or by us in writing.
• Do not reverse engineer, decompile, or extract source code from any software in the Service to the extent such restriction is permitted by law.
• Do not upload unlawful, infringing, or harmful content, and do not violate third-party rights.

6) User Content and Feedback

If you submit or upload content (e.g., profile information, avatars) you represent that you have the necessary rights and that your content does not violate the law or third-party rights.

By sending feedback or suggestions, you grant Falando a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate your feedback in our products and services without obligation to you.

7) Intellectual Property

The Service, including its content, software, text, graphics, and trademarks, is owned by Falando or its licensors and is protected by intellectual property laws. No rights are granted to you except as necessary to use the Service under these Terms.

8) Third-Party Services

We rely on third parties to provide parts of the Service, such as database, authentication, storage, text-to-speech, and payments. Your use of those features may be subject to the third parties’ own terms and policies.

• Supabase: database, authentication, and storage.
• OpenAI (Text-to-Speech): generating audio for requested text.
• Payment provider: processing subscription payments.

9) Availability and Changes

We strive to keep the Service available and running smoothly, but it may be unavailable from time to time due to maintenance, outages, or events beyond our control. We may modify or discontinue features at any time with reasonable notice when feasible.

10) Termination

We may suspend or terminate your access to the Service if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive (e.g., IP, disclaimers, limitations of liability).

11) Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Falando disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and noninfringement. Educational content may contain errors; we do not guarantee specific learning outcomes.

12) Limitation of Liability

To the maximum extent permitted by applicable law, Falando will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service. Nothing in these Terms limits rights that cannot be limited under the Brazilian Consumer Defense Code.

13) Governing Law

These Terms are governed by the laws of Brazil. If you are a consumer, disputes should be resolved by the courts of your domicile, as provided by the Brazilian Consumer Defense Code, without prejudice to any mandatory rights under applicable law.

14) Changes to These Terms

We may update these Terms to reflect changes to the Service or the law. When we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
