By using Falando you agree to the terms below. Where Brazilian consumer-protection or data-protection law grants you mandatory rights, those rights prevail over anything in this document.

1. Company and contact
Falando is operated by PATRYK MATEUSZ GRABOWSKI LTDA (CNPJ 61.434.746/0001-06), Rua Joaquina de Jesus 127 Lote 16, Vila Isolina Mazzei, São Paulo SP, 02079-070. Contact: contact@falando.app.
2. Eligibility and accounts
- You must be at least 13 years old to use Falando. Users between 13 and 18 need parental or guardian consent.
- You are responsible for keeping your login credentials secure.
- One account per person; automated sign-ups are not permitted.
- We may suspend or terminate accounts that violate these terms after giving reasonable notice.
3. The Service and plan access
Falando is a Brazilian-Portuguese language-learning platform. Features are grouped into a free tier and paid plans. The feature set of each plan is described on the Pricing page and may change with reasonable advance notice.
4. Subscriptions, billing, renewal, cancellation, and refunds
- Paid plans are billed monthly or annually through Stripe.
- Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
- You may cancel at any time from Settings → Subscription. Access continues until the end of the current paid period.
- Refund requests are handled under our separate Refund Policy (linked above) and in compliance with the CDC (Art. 49 – 7-day reflection period for remote purchases).
- Price changes will be communicated at least 30 days in advance and take effect at the next renewal.
- If a payment fails, we may retry the charge and, after reasonable notice, downgrade your account to the free tier.
5. Acceptable use
- Do not reverse-engineer, scrape, or redistribute any part of the platform.
- Do not use bots, scripts, or automated tools to interact with the service (browser extensions offered by Falando are excepted).
- Do not upload illegal, offensive, or infringing content through BYOC or any other feature.
- Do not attempt to circumvent access controls, rate limits, or subscription gates.
- Report security vulnerabilities responsibly to contact@falando.app.
6. User content and feedback
You retain ownership of any text, recordings, or other content you submit. By submitting content you grant Falando a worldwide, royalty-free licence to process it solely for delivering the service (e.g., AI-based evaluation). Feedback and feature suggestions may be used freely to improve the product without compensation, unless otherwise agreed in writing.
7. Intellectual property
All platform code, design, lesson content, and brand assets belong to PATRYK MATEUSZ GRABOWSKI LTDA or its licensors. Your subscription grants a personal, non-transferable, non-exclusive licence to use the service for private educational purposes. You may not:
- Copy, redistribute, or publicly display platform content without written permission.
- Use Falando trademarks or logos without prior authorisation.
- Claim ownership of AI-generated exercises, explanations, or evaluations produced by the service.
8. Third-party services and AI-assisted features
Falando relies on third-party providers including Supabase (database), OpenAI and Anthropic (AI), and Stripe (payments). Their respective terms apply to data processed by their systems. AI features (grammar explanations, exercise evaluation, exam scoring) are assistive and may contain errors. They do not constitute professional language-certification advice.
9. Availability, beta features, suspension, and termination
- We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be announced when practical.
- Features marked "Beta" may change or be removed without notice.
- We may suspend access immediately if we detect a serious violation of these terms (e.g., security threats, abusive behaviour).
- On termination you may request a copy of your personal data within 30 days, after which it will be deleted in accordance with the Privacy Policy.
10. Liability, mandatory rights, and governing law
To the extent permitted by Brazilian law, Falando's aggregate liability for any claim arising from the service is limited to the total amount you paid in the 12 months preceding the claim. This limitation does not affect mandatory consumer rights under the CDC or data-subject rights under the LGPD. These terms are governed by the laws of the Federative Republic of Brazil. Disputes shall be submitted to the courts of the city of São Paulo – SP, without prejudice to your right to use a consumer-protection forum at your domicile.
11. Changes to these Terms and how to contact us
We may update these terms to reflect legal or product changes. Material updates will be notified via in-app notification at least 15 days before they take effect. Continued use after the effective date constitutes acceptance. For questions, contact contact@falando.app.
